VR RELEASE AGREEMENT
By booking and participating in activities utilizing a Virtual Reality (VR) headset and/or other equipment provided by Travel Point Group, you acknowledge and agree to the following Release of Liability, Waiver of Legal Rights, and Assumption of Risks:
DEFINITION: In this Release Agreement, the term “Activities” refers to all activities associated with the participants’ use and/or participation in VR activities, including any services, orientation and/or instructional sessions, related activities, and/or use of facilities provided by or arranged by Travel Point Group.
1. I acknowledge that the above Activities involve certain risks, danger, and hazards, and such activity is subject to mishap and even injury to participants. I understand that by my participation I may become injured, including any injury caused by, but not limited to, any fall and/or impact with surrounding objects or other participants, any equipment failure, any entanglement with any person and/or object, any act of negligence on the part of Travel Point Group or other person, and any other injuries that may occur while participating in the above Activities.
2. I hereby RELEASE AND DISCHARGE TRAVEL POINT GROUP, its servants, agents, officers, elected officials, volunteers, sponsors, employees, successors, and assigns (hereinafter collectively referred to as “THE RELEASEES”) for the above Activities from any and all liability, claims, demands, or causes of action that I may hereafter have for injuries and/or damages arising out of my participation in the above Activities, including, but not limited to, losses CAUSED BY THE NEGLIGENCE OF THE RELEASEES.
3. I understand and acknowledge that the above Activities have inherent dangers that no amount of care, caution, instruction, or expertise can eliminate and I EXPRESSLY AND VOLUNTARILY ASSUME ALL RISK OF PERSONAL INJURY SUSTAINED WHILE PARTICIPATING IN THE ABOVE ACTIVITIES WHETHER OR NOT CAUSED BY THE NEGLIGENCE OF THE RELEASE PARTIES.
4. I further agree that I WILL NOT SUE OR MAKE A CLAIM against the RELEASEES for any injury, damages, or other losses sustained as a result of my participation in the above Activities. I also agree to INDEMNIFY AND HOLD THE RELEASEES HARMLESS from all claims, judgments, and costs, including attorneys’ fees, incurred in connection with any action brought as a result of my participation in the above Activities.
5. I will take full responsibility for, and hold harmless RELEASEES for any injury or damage that I may suffer or inflict upon others or their property as a result of my participation in above Activities.
6. I agree that I will operate any equipment in a reasonable and safe manner so as not to endanger the persons or property of any individual, including the RELEASEES.
7. I further represent that this Release Agreement shall continue in full force and effect for so long as I engage in the above Activities which are in any way connected to or with the RELEASEES.
By booking and participating in VR activities with Travel Point Group, I have read and understood the above and acknowledge that the same constitutes a release of liability and a waiver of my legal rights and also acknowledgement of the assumption of liability by me of all risks arising out of my engaging in above Activities. I hereby expressly recognize that this Release Agreement is a contract pursuant to which I have released any and all claims against the Released Parties resulting from participation in above Activities including any claims due to the negligence of the RELEASEES by any of the undersigned.
I HAVE READ THIS RELEASE OF LIABILITY, WAIVER OF LEGAL RIGHTS AND ASSUMPTION OF RISK AND FULLY UNDERSTAND ITS CONTENTS. I AGREE TO BE BOUND BY IT BY BOOKING AND PARTICIPATING IN VR ACTIVITIES WITH TRAVEL POINT GROUP.
